the best way to put this to the test would be opening a 2nd-hand digital shop for profit... 
 
nobody would attack something for charity, it's bad press.
 
all this did was raise the question pre-emptively for some corporate lawyers so they can firm up the grounds to sue someone who actually tries to resell digital audio to cut losses or earn some extra dough...
 
of course, it is an interesting idea... starting a resale shop of digital audio for charity... i'd buy and sell from soemthing like that if it was going to a good cause...
