Of course not. This is how Dr. Dre and The Beastie
Boys get sued by artists they've sampled. Some of the
samples listed below may be cleared, perhaps on a
sliding scale of "likely to notice or care", but I
would be greatly surprised if all of those samples are
cleared.
And yes, they are encouraging others to sample.
Hip-Hop is very grass-roots. Hip-Hop songs have for
years have included either instrumental versions,
individual loops, or long, long breakdowns on their
recordings, specifically so the samples that they
reused in their songs could be reused yet again.
In late 2000, "Nightline" produced a three part series
that went into this in some depth, looking at the
democratic nature of Hip-Hop and comparing it to other
forms of collage. Very instructive, I highly
reccomend it.
