[rumori] Music industry reimbursement settlement

Hmmm, I just heard about this today. Apparently there was some sort of
anti-trust lawsuit against several record labels for encouraging record
stores to charge lots of extra money for cd's. Apparently the record labels
are offering a settlement (without admitting any wrongdoing), and any person
who purchased new CDs between 1995 and 2000 can get some money back. However
it would probably be better to get your name on a list of people NOT
accepting the settlement, since accepting disqualifies you from
participating in another similar lawsuit.

Haven't had the chance to look into this, but here's what I read on this
week's Aquarius Records newsletter:

Last list we mentioned the music industry reimbursement settlement,
remember? Every person who bought a cd was entitled to a refund due
to labels' illegal price fixing. Well, the link we included didn't
work, but we got tons of emails form different folks and it is indeed
for real. Here's the news release from the California Attorney
General:

And here's where you sign up:

But another customer warns:
"The rub is that by accepting the settlement you forfeit all future
claims against these companies and agree that this is a fair
settlement. How many CDs did you buy in those five years? Keep in
mind that the lawyers get paid out of that $20, too, so the real
amount is likely to be much less. However, you can sign up *not* to
accept the settlement and preserve your ability to participate in a
real judgement against the RIAA cartel (not the RIAA itself...the
companies who comprise the RIAA are the defendants in this case)."

>From the settlement:
"If you do not wish to be bound by the terms of the proposed
Settlement described in this Notice, you may request to be excluded
from the Settlement. To do so, you MUST send a written request for
the exclusion to:

Compact Disc MAP Antitrust Litigation Administrator
Post Office Box 1643
Faribault, Minnesota 55021-1643

Your request for exclusion must be postmarked by or before March 3,
2003, must clearly state that you want to be excluded from the
Settlement, and must provide your full, legal name(s), address,
telephone number, and the name and number of this Litigation (In re:
Compact Disc Minimum Advertised Price Antitrust Litigation, MDL
Docket No. 1361). NO REQUEST FOR EXCLUSION WILL BE CONSIDERED VALID
UNLESS ALL OF THE INFORMATION DESCRIBED ABOVE IS INCLUDED IN ANY SUCH
REQUEST."

So, investigate further if you wish, and make your decision...
